OFFICIAL RULES

BY ENTERING THE SWEEPSTAKES, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT

  1. SWEEPSTAKES PROMOTIONAL PERIOD: The #DoorMakeover 2 Giveaway Sweepstakes (the “Sweepstakes”) begins at 12:00 am EDT, Thursday, June 1, 2017, and ends at 11:59pm EDT, Wednesday, July 5, 2017 (the “Promotion Period”). Sponsor’s computer is the official clock for the Sweepstakes.
  2. ELIGIBILITY: The Sweepstakes is open to all legal residents of the 50 United States and the District of Columbia to whom this offer is addressed and who have reached the age of majority at the time of entry.  Employees, independent contractors, officers, and directors of Sponsor and its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and immediate family members of each are not eligible to participate in the Sweepstakes.  The Sweepstakes is void where prohibited or restricted by law.  Entry in the Sweepstakes constitutes your (“Entrant”) full and unconditional agreement to and acceptance of these Official Rules.
  3. HOW TO ENTER: There are two methods of entry for this Sweepstakes.  NO PURCHASE NECESSARY TO ENTER OR WIN.  To enter and participate in the Sweepstakes, visit Zabitat’s (“Sponsor”) Facebook page at https://gleam.io/fb/beqtn.  Click on the #DoorMakeover Contest tab, follow the instructions, enter all required registration information including name and email address, and opt in to one email communication option, at anytime during the Promotion Period (“Registration Information”).   Upon electronic submission of the required registration, Entrants will automatically receive one entry into the Sweepstakes.

LIMITS: Limit one entry per Entrant for each entry type within the Promotional Period with the exception of the social sharing entry type. All entries must be received by 11:59 pm EDT, Monday, May 1, 2017, in order to be eligible for the prize drawing.   All entries become the property of Sponsor and will not be acknowledged or returned.

ENTRANT DATA AND PRIVACY: Submission of the Registration Information and any prize notification documents (“Entrant Data”) constitutes your consent for Sponsor to obtain, use, and transfer your name, address, and other details for Sweepstakes administration purposes. Any Entrant Data shall be used only in a manner consistent with the consent given by Entrants at the time of entry, with these Official Rules, and with Sponsor’s Online Privacy Policy, which can be found at http://www.zabitat.com/privacy-policy. Submission of personal and contact information in connection with the Sweepstakes constitutes permission for Sponsor to add participant to Sponsor’s customer database and to contact participant for future promotions, events, and offers.  Entrants may opt out of receiving such communications as set forth in Sponsor’s Privacy Policy.

  1. PRIZES, PRIZE DRAWING, AND ODDS OF WINNING:

PRIZE DRAWING:  Sponsor will conduct one (1) random prize drawings from all eligible entries received at the conclusion of the Promotions Period. Odds of winning depend on number of eligible entries received. The drawings will be conducted by Sponsor, whose decisions are final on all matters relating to this Sweepstakes, and will occur live via Sponsor’s Facebook page at https://www.facebook.com/zabitat. Non-winning entries will not carry forward to or be included in any subsequent sweepstakes or prize drawings of Sponsor.

PRIZE DETAILS:  Total of one (1) Grand Prizes. One (1) winner will receive one (1) Door Glass Insert from https://www.zabitat.com/ with a maximum value of $500.  If the Grand Prize is unavailable, Sponsor may substitute an item of equal value for the Prize.

PRIZES WILL BE ACCEPTED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED (INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE). Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a prize manufacturer that may be sent along with a prize.  The Winner will not be obligated to purchase any other Sponsor products or services. Entrants indemnify, release, and hold harmless Sponsor from losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, or possession of the prize resulting from participating in this Sweepstakes. Entrant acknowledges and agrees that Sponsor has not arranged for nor carries any insurance of any kind for the benefit of Entrant or that of Entrant’s heirs, executors, and administrators relative to Entrant’s use of the Prize awarded to Entrant; and that Entrant is solely responsible for obtaining and paying for any insurance relative to the prize awarded to Entrant.

  1. WINNER NOTIFICATION & VERIFICATION: The potential prize winner will be notified by telephone or e-mail and will be required to complete, sign, and return a notarized Affidavit of Eligibility/Release of Liability, and, where legally permissible, a Publicity Release (the “Affidavit & Releases”). The potential winner is required to return the Affidavit & Releases within seven (7) days from the postmarked date of notification.

Execution of the Affidavit & Releases and acceptance of a prize constitutes the Winner’s consent to use of Winner’s name, likeness, and biographical information, including city and state of residence, for advertising and promotional purposes by Sponsor and its designees, including but not limited to the posting of Winner’s name on the Sponsor’s websites, social media accounts, and in a Winners List (“Promotions”), without additional compensation, except where prohibited by law. All copyright, trademark, or other intellectual property rights in such Promotions shall be owned by Sponsor or its licensors, and Winner hereby disclaims and waives any claim of right to or control over such Promotions, as well as any possible claims of misuse of Winner’s name under contract, tort, or any other theory of law.

Sponsor shall have no liability for any potential prize winning notification mailing that is lost, intercepted, or not received by any potential winner for any reason.  Sponsor is not responsible for lost, misdirected, illegible, late, or postage-due mailing sent by any potential winner.  If, despite reasonable efforts, any potential prize winner does not respond within seven (7) days of the first notification attempt, or if the prize notification is returned as unclaimed or undeliverable to such potential prize winner, such potential prize winner will forfeit his/her prize, and an alternate winner may be selected.  Sponsor will deliver prize to winner within ten (10) days for receipt of executed Affidavit & Releases.

If any potential prize winner is found to be ineligible, or if he/she has not complied with these Official Rules or declines a prize for any reason prior to award, such potential prize winner will be disqualified, and an alternate Winner may be selected in another random drawing on a date and time determined solely by the Sponsor.

  1. GENERAL RULES: By participating in this Sweepstakes, Entrants agree to be bound by these Official Rules and by all of Sponsor’s and its agencies’ decisions, which are final and legally binding in all matters relating to this Sweepstakes.  By entering the Sweepstakes, Entrants and the potential winner agree to release, discharge, indemnify, and hold harmless the Sponsor, its affiliates, officers, directors, employees, representatives, and agents from and against any claims, damages, or liability due to any damages, or losses or injuries to any person (including death) or property of any kind resulting, in whole or in part, directly or indirectly, from acceptance, possession, misuse, or use of the prize or participation in this Sweepstakes or any Sweepstakes-related activity.  Entrants and Winners further agree not to pursue any right, claim, or action against Sponsor, its affiliates, officers, directors, employees, representatives, or agents in connection with their participation in this Sweepstakes.

Sponsor is not responsible for incorrect or inaccurate transcription of entry information, or for any human or printing error in these rules or any promotional materials, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, or any other error or malfunction, or any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation in the Sweepstakes, or for late, lost, stolen, illegible, or misdirected entries. In case of a dispute as to the owner of an entry, entry will be deemed to have been submitted by the authorized account holder of the email address provided in the entry form. The authorized account holder is deemed as the natural person assigned to an email address by an Internet access provider, service provider, or other organization responsible for assigning email addresses or the domain associated with the submitted email address.

Sponsor reserves the right at its sole discretion to disqualify any individual whom it suspects has tampered or attempted to tamper with the entry process or the operation of the Sweepstakes, or who violates the Official Rules.  If for any reason the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes and award the prizes from among all eligible entries received prior to cancellation or termination.  The prizes are nontransferable, and no substitutions are allowed except at the Sponsor’s sole discretion.  No cash equivalent or exchange of prizes is permitted (except at the Sponsor’s sole discretion).  In the event of time of war, national emergency, accident, dangerous weather conditions, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, Sponsor has the right, in its sole discretion, to terminate the Sweepstakes. Notice of such action will be posted online at blog.zabitat.com/. Caution: Any attempt by a participant or any other individual to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law.

  1. TAXES & FEES: All taxes, fees, and surcharges for a prize and all expenses not explicitly included in the description of the prize shall be the sole responsibility of the Winners.
  1. GOVERNING LAW & REMEDIES:  This Sweepstakes is conducted in English. Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with this promotion, shall be governed by, and construed in accordance with, the laws of Michigan, without giving effect to any choice of law or conflict of law rules (whether of Michigan, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Michigan.

This Sweepstakes is void where prohibited.  Sponsor and Entrants agree that the state courts of Michigan shall have sole jurisdiction over any judicial proceeding for disputes, claims, and causes of action arising out of the Sweepstakes, and the venue for any such judicial proceeding shall be Ottawa County, Michigan. 

BY ENTERING THE SWEEPSTAKES, ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), NOT TO EXCEED FIFTY DOLLARS ($50.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED FIFTY DOLLARS ($50.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY. 

  1. WHO WON:  For the names of the prize winners, available from 5/2/2017 to 6/2/2017, please access: https://blog.zabitat.com/doormakeover-giveaway/. For the names of the prize winners on or after 6/2/2017, send a self-addressed, stamped envelope, by 12/30/2018, to #DoorMakeover GIVEAWAY WINNER’S NAME REQUEST, 101 E ROOSEVELT, SUITE B, ZEELAND, MI 49464.
  1. SPONSOR: The Sponsor of the #DoorMakeover Giveaway is Zabitat LLC, 101 E Roosevelt, Suite B, Zeeland, Michigan 46464 (the “Sponsor”).
  1. MISCELLANEOUS: The invalidity or unenforceability of any provision of these Official Rules or the Affidavit will not affect the validity or enforceability of any other provision.  In the event that any provision of the Official Rules or the Affidavit & Releases is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.  When terms such as “may” are used in these Official Rules, Sponsor has sole and absolute discretion.  Entrants agree to waive any rights to claim ambiguity of these Official Rules.  Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the Official Rules or any provision hereof.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy, or terms of use on the Sponsor’s website and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control, and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
